Miria, the main reason corporations bend over and take it is that most people think like fifthfiend was doing a few pages back-

Rupert Murdoch may not deserve that $30 million, but at least he put in SOME work to get it. This 14-year old skank just let some creep feel her up, and, in my opinion, deserves the money ever less than Murdoch. Pretty soon, we'll be facing a massive economic collapse because everything is gonna cost 10 times what it does now to counter-act the legal fees incrued from cretins who swallow an entire can of peanut butter (without even opening the jar) PURELY so they can sue someone and retire. Also, on the end of the world side discussion we've been having, I prefer the Mayan calendar's 2042 (I think) dead line(pun intended). Those Mayans really knew their stuff. Their calendar even had Lincoln's birthday fur Chrissakes! |

You know what Murdoc really doesn't care none of this comes out of his pocket directly. The coperation absorbs the cost and distrubites it to all shareholders, although I do believe the ones with the largest precentage get hit first. So yeah he's so being taught a lesson here.
Aside from that, yeah I totally agree that the coperation should take at least a little responsibility they could have been doing at least a little more to protect their members. Also, a large sum is probably the only way to get it through their heads. However, giving that money to someone not responisble enough to know better isn't exactly an answer. See when you do that it teaches that person, and anyone else that hears about the case, that they don't have to take responisbility for their actions. Hell they'll even get rich if they don't its win-win. Now see if a modest sum was diverted to the viticm from some sort of fine imposed by the FCC or something that'd be fine. A little something for their trouble maybe few thousand dollars. The other 30 million or so could go to I don''t know fixing the problem better than the company is going to do on its own. Left to themselves the coperation will do just enough to avoid a similar lawsuit and that doesn't really address the more basic problem. But yeah give the obscene amount of money to a person that doesn't deserve so they'll learn all about responsibilty... oh wait nevermind. Its not like there is a better way that money could be used to prevent further similar events... woops did it again. Well at least the guy no one likes that heads the company is getting punished good for something that was only tangently his fault... damn I gotta stop doing that. No excuse me while I go see if I can sue Blizzard because someone was greifing me on WoW. I can't lose! |
I was going to post saying that anti-litigation hysterics are all well and good* until someone like CrazyBen comes along and not only suggest that there was no actual wrongdoing from any party, but literally blames the victim. A skank?
But who am I kidding. This line of thinking is pervasive in all of this thread. As fifthfiend noted, the laws that allow such litigation are as valid as the laws that allowed Rupert Murdoch to pocket so much money. Private property doesn't exist in a legal vacuum. *Not really. |
Well she is at least partially at fault, and so is the website as well as the parents and pretty much everyone involved. However, a small compensation is enough there was no need to give someone 30 million dollars. The best way to make them change would be to take that extra nearly 30 million and make the company use it to research and fix the problem. Sure they could, and probably would, do the 6 million dollar patch to avoid another suit but that's not a complete fix. You won't get a complete, or as near complete as you could possibly get, unless you force the issue in well a forcefull manner.
Even Fifth mentioned this guy has 6 billion dollars to his name add to that he probably makes more that ten or twenty times the amount being sued for in a year (hell maybe in a few months) and that his cooperation absorbs most of the cost and its not really all that big of a punishement. |

The family is to blame for not keeping a better eye on the girl, who herself is at fault for not using common sense. The guy's to blame just for the fact that he went after her, and the site's to blame for not having good protections for those not of legal age, as was mentioned before. But you know, this guy's just going to just give him the money, and just put up some security. Again, like was said before, then those who are after the younger kids will just lie and say that they're 14-15, and the younger kids will say that they're 20-something and sound all adult and the like.
I'm starting to think that a general purging and clensing of humanity is sounding REAL good right about now. Just wipe out oh...2 billion. That way, we'll at least get some of the idiots. |
