As part of their bankruptcy, it seems Midway is seeking to sell off the Mortal Kombat franchise:

Midway Games Inc. and its affiliates filed a motion on February 23, 2009 seeking court authority to implement a key employee incentive plan covering up to 29 employees. Midway Games filed for bankruptcy protection on February 12, 2009 (more details are available here).

The motion describes the group of 29 eligible employees as “officers, management-level employees and other non-insider key employees.” The proposed plan ties bonus payments to three designated milestones. If all milestones are met, the total bonus pool available for distribution would be $3,755,000. For each milestone payment, each employee eligible to participate in the plan would receive a set percentage of the bonus amount designated for that milestone. The three milestones and the bonus amounts for each milestone are:

1. Milestone: Entry into a publishing/distribution agreement for Midway’s new “Wheelman” game (apparently already accomplished), performance by Midway entitling it to gross proceeds of $6 million under the agreement by March 1, 2009, and actual receipt of those proceeds. Bonus Amount: $497,500.
2. Milestone: Either (i) execution of an asset purchase agreement for the sale of Midway’s Mortal Kombat franchise assets or (ii) submission by Midway of a plan of reorganization to continue as a going concern. Bonus Amount: $1,292,500.
3. Milestone: The earlier to occur of (i) confirmation of a plan of reorganization or liquidation or (ii) closing of a sale of Midway’s Mortal Kombat franchise assets. Bonus Amount: $1,965,000.

Court documents surrounding the company's fight for survival have shown that Midway executives have set aside $3,755,000 in bonuses, which is to be divided amongst 29 "officers, management-level employees and other non-insider key employees" if they're able to meet certain goals.

One of those goals was in offloading Wheelman, which Ubisoft just picked up. So that's $497,500 in the pocket. Another objective (so important it's actually listed twice) is being able to secure the "execution of an asset purchase agreement for the sale of Midway's Mortal Kombat franchise assets".

On the one hand, selling off the Mortal Kombat rights might net them enough cash to keep their heads above water. On the other, however, Mortal Kombat is the only thing Midway have left.

Oh, and if you're wondering where a company can find $3,755,000 while in the midst of filing for bankruptcy, that's easy! There's always money to go around when you hold out on paying sacked employees the remainder of their PTO (paid/personal time off), something Midway originally promised they'd do.

If i got this right, they are letting go the only games they could actually sell and screwing up most of it's employees on the process...

...it's times like this that I wish there were a court body that could say, "Hey no, you can't do that. Stop being a douchebag." Still, I hope someone good gets Mortal Kombat. It's not my type of game, but hey.

You know and I actually liked MKVDC.

Oh well, maybe someone will get the franchise and actually do something really great with it rather than flushing down hundreds of thousands of dollars on their good name alone.

EDIT: And seriously, Midway, what the fuck? Hey let's use the shattered remnants of our funds to supply bonuses to the higher-ups rather than pay our unpaid employees? Fuck, you guys can collapse all you want, you're clearly already heading out the door.

Square Enix has been intending to buy a Western developer for a long time. They might as well get the rights to the franchise while they can.
