There's rumors being kicked around that Nintendo might pass off more franchises to Rare considering how well they treated Metroid Prime, this might be the fruit of that.

I don't think NoA has any legal grounding on a translation ROM hack getting shut down. It's effectively a mod, which are mostly legit.
It wasn't like Halogen or Chrono Resurrection, which was making a game from scratch in a current franchise by independent programmers and thus 'stealing' a game that the official designers could make.

I didn't say they were legal, I said they have less legal ground. They'd have even less incentive to shut it down anyway.
Mods generally don't take away from the game's profit, and sometimes contribute to it (KOTOR II's Team Gizka project for example, or any of The Sims fan community mods), but as for a patch for a three-year old japanese-only release for a handheld, out-of-date console, that turns it into English so people can play it on their PCs, yeah, I don't think you're going to hurt the sales. The only exception to rules like that is stuff like the aforementioned Halogen, where they shut it down specifically because they were already in the process of making a Halo RTS and it would really kill their sales if there was a free version free to play. It's very ambiguous and they could get away with a C+D if they wanted to, but there's still not much of a point, considering most fans of Mother'd buy the crap out of a USA release. However, it's very moot since Nintendo's made it perfectly Goddamn clear they don't plan on bringing Mother 3 to the US. Quote:
